These Terms of Service ('Terms') constitute a legally binding agreement between you ('User') and QuickQuote Group Pty Ltd (ABN 99 698 266 483), trading as QuickQuote ('QuickQuote', 'we', 'us', 'our'). By registering an account or accessing the QuickQuote platform, you agree to be bound by these Terms in full. If you do not accept these Terms, you must not use the Platform.
Nature of platform: QuickQuote is a digital marketplace that facilitates introductions between Customers and Service Providers. QuickQuote does not provide, perform, supervise, warrant, or guarantee any services arranged through the Platform. All service agreements are formed directly and exclusively between Customers and Service Providers. QuickQuote is not a party to those agreements. QuickQuote separately makes available an optional Payment Service, described in Section 7, through which a Customer may pay a Provider for already agreed services. QuickQuote does not hold, custody, or control any funds paid through the Payment Service at any time.
In these Terms, unless the context requires otherwise:
A reference to a 'clause' or 'section' is a reference to a clause or section of these Terms. Headings are for convenience only and do not affect interpretation.
QuickQuote operates as a neutral digital marketplace and lead generation platform. Our role is limited to facilitating introductions between Customers seeking trade or professional services and Providers who offer such services.
QuickQuote does not provide, perform, arrange, supervise, manage, endorse, or guarantee any services offered or delivered by Providers; participate in pricing, quoting, negotiations, or payment for services; inspect or control the quality or safety of any work; enter into any contract or arrangement for the provision of services between a Customer and a Provider; or bear any responsibility for the conduct, acts, or omissions of any Provider or Customer.
The only exception to the above is the optional Payment Service described in Section 7, through which QuickQuote facilitates, but is not a party to, a payment from a Customer to a Provider for services already agreed between them. The Payment Service does not extend QuickQuote's role beyond facilitation of that payment: QuickQuote remains not a party to the underlying service agreement, and does not participate in pricing, quoting, or negotiation of the services themselves.
All service agreements, pricing, quoting, and service delivery are matters exclusively between the Customer and the Provider. QuickQuote is not a party to those arrangements.
The Platform operates as follows:
To access and use the Platform, you must be at least 18 years of age; have full legal capacity to enter into and be bound by a binding agreement under Australian law; where registering on behalf of a company, partnership, or other legal entity, have proper authority to bind that entity to these Terms; and not be subject to any legal prohibition that would prevent you from lawfully using the Platform.
By using the Platform, you represent and warrant that you meet all eligibility requirements. If you do not meet these requirements, you must not use the Platform.
You must create an Account to access the Platform’s core features. When registering, you agree to:
You must notify us immediately at hello@quick-quote.com.au if you become aware of any unauthorised access to your Account. QuickQuote is not liable for any loss arising from unauthorised use of your Account resulting from your failure to maintain adequate security of your credentials.
Each individual or entity may maintain only one active Account on the Platform at any time. Creating duplicate, fraudulent, or impersonation Accounts constitutes a material breach of these Terms and will result in immediate termination of all associated Accounts.
You may delete your Account at any time directly within the Mobile App through Profile, Account Settings, Delete Account, or by emailing hello@quick-quote.com.au. Upon deletion, your access to the Platform will cease immediately. Personal information will be handled in accordance with our Privacy Policy and applicable legal retention requirements.
Customer access to the Platform is provided at no charge. QuickQuote does not charge Customers any registration fee, commission on jobs, referral fee, or other platform fee at this time, other than the optional fees described in Section 7 that apply only where a Customer chooses to use the Payment Service. QuickQuote reserves the right to introduce further fees for Customers in the future, with no less than 30 days’ advance written notice.
As a Customer, you may submit job requests on the Platform, subject to the following conditions:
QuickQuote does not verify, credential check, background check, licence confirm, or otherwise vet any Service Provider at any point. Even where a Provider has uploaded documents, certificates, or credentials to the Platform, or displays an automated verification badge, QuickQuote does not verify the authenticity, currency, scope, or validity of any such documents beyond the limited automated check described against them, and does not accept responsibility for any error in or reliance placed upon that automated check.
You, as the Customer, are solely and entirely responsible for conducting all necessary and appropriate due diligence, background checks, licence and registration verifications, insurance confirmations, reference checks, and any other assessments before engaging any Provider to perform any services, and before choosing to pay a Provider through the Payment Service or otherwise.
Prior to engaging any Provider, Customers are strongly encouraged to:
Access to job leads and the ability to express interest in Customer postings is available to Providers only upon payment of an active monthly Subscription. The current Subscription fee is $49.00 AUD per month (GST inclusive where applicable). This fee is subject to change in accordance with Section 6.5.
By registering as a Provider and maintaining an active Subscription, you represent and warrant on an ongoing basis that:
Breach of any of the above representations or warranties constitutes a material breach of these Terms and may result in immediate suspension or termination of your Account without refund.
A Subscription entitles a Provider to access job leads distributed to Providers in relevant service categories and geographic areas. QuickQuote makes no representation, warranty, or guarantee regarding the volume, frequency, quality, recency, or outcome of job leads, or that any Customer will engage the Provider, or that any Customer will choose to pay through the Payment Service rather than by other means. The Subscription fee is charged solely for access to the Platform and distribution of job leads, not for any minimum volume of leads, work, or revenue.
Providers must not:
Provider Subscriptions are billed through one of the following channels depending on how you subscribe:
This Section 6 concerns only a Provider's own Subscription payment to QuickQuote. It is separate from, and not affected by, the Payment Service described in Section 7, through which a Customer may pay a Provider for services.
Subscriptions are billed monthly, commencing on the date of initial subscription activation. Renewal charges are processed automatically at the commencement of each new billing cycle. You will receive confirmation of each charge to your registered email address (web subscriptions) or through your Apple ID or Google account (mobile app subscriptions).
All Subscriptions automatically renew at the end of each billing cycle unless cancelled at least 24 hours before the end of the current period. You may cancel your Subscription at any time through your QuickQuote Account settings (web), your Apple ID account settings (iOS), or your Google Play account settings (Android).
Cancellation is effective at the end of the then current billing cycle. You retain Platform access through the remainder of the paid period. No partial period or prorated refunds are issued upon cancellation, except as required by the ACL.
Subscription fees are non refundable once charged, except as expressly required by the Australian Consumer Law (ACL) or as required by the refund policies of Apple (for iOS subscriptions) or Google (for Android subscriptions). QuickQuote does not issue refunds for partial subscription periods, unused access, change of mind, failure to use the Platform, or dissatisfaction with the volume or quality of job leads received.
For subscriptions purchased through the Apple App Store, refund requests must be made directly to Apple through reportaproblem.apple.com. For subscriptions purchased through Google Play, refund requests must be made directly to Google through your Google Play account. QuickQuote cannot process refunds for mobile app subscriptions.
Nothing in this refund policy excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the ACL. Where the ACL mandatorily requires a refund or other remedy, we will provide it.
QuickQuote may amend Subscription fees at any time. We will provide Providers with no less than 30 days’ advance written notice of any fee increase, delivered to the registered Account email address. Your continued use of the Platform after the effective date of a fee change constitutes acceptance of the new fee. If you do not accept a fee change, you may cancel your Subscription before the change takes effect.
If a scheduled Subscription payment fails, we will use reasonable efforts to notify you and allow you an opportunity to update your payment details. Repeated failed payments may result in suspension of your Account and loss of access to job leads without refund of amounts previously charged.
All prices are stated in Australian Dollars (AUD). Where applicable, prices include Goods and Services Tax (GST) as required by the A New Tax System (Goods and Services Tax) Act 1999 (Cth). Tax invoices for Subscription fees will be made available through the Platform or delivered by email.
QuickQuote makes available an optional feature enabling a Customer to pay a Provider for services already agreed between them, using Stripe as a third party payment processor (the 'Payment Service'). Use of the Payment Service is entirely optional. Customers and Providers remain free to arrange and settle payment for services by any other lawful means, including cash or direct bank transfer, entirely outside the Platform, and QuickQuote does not require or condition access to the Platform on use of the Payment Service.
The Payment Service operates on a direct, pass through basis. When a Customer elects to pay a Provider through the Platform, the payment is charged directly to a Connect Account established and controlled by the Provider with Stripe. At no point does QuickQuote receive, hold, custody, control, or have access to funds paid by a Customer to a Provider. QuickQuote is not a bank, authorised deposit taking institution, or provider of a designated remittance service, and does not operate as an escrow agent in respect of any payment made through the Platform. QuickQuote does not offer, and the Payment Service does not constitute, any form of payment protection, insurance, or guarantee scheme.
QuickQuote charges a platform facilitation fee (currently 2% of the agreed price, subject to change on no less than 30 days' notice consistent with the approach in Section 6.5) for use of the Payment Service, deducted from the amount otherwise payable to the Provider. Stripe's own card processing fee applies in addition and is shared between the Customer and the Provider, as disclosed on the Platform before the Customer confirms payment. QuickQuote's fee is consideration for facilitating the payment transaction only and does not constitute, and must not be construed as, any warranty or guarantee regarding the underlying services.
A Provider wishing to receive payments through the Payment Service must establish a Connect Account directly with Stripe, including providing identity, business, and bank account information required by Stripe and applicable law, including anti money laundering and counter terrorism financing requirements. QuickQuote does not verify, and makes no representation as to the accuracy of, any information a Provider submits to Stripe in connection with a Connect Account. Stripe's own terms of service (available at stripe.com/legal) govern the operation of the Connect Account and apply directly between the Provider and Stripe. A Provider may disconnect from the Payment Service at any time through the Platform; doing so does not affect the Provider's Connect Account with Stripe, which the Provider continues to control directly.
QuickQuote does not guarantee that any payment initiated through the Payment Service will be successfully processed, that funds will be received by a Provider within any particular timeframe, or that a Connect Account will remain active or in good standing. Payment processing is subject to Stripe's own systems, risk controls, and terms, over which QuickQuote has no control and for which QuickQuote accepts no liability.
QuickQuote is not a party to, and assumes no liability in connection with, the underlying service agreement between a Customer and a Provider, or any payment made in connection with that agreement. Use of the Payment Service does not alter the nature of the Platform as an introduction service, as described in Section 2, and does not create any agency, trust, or fiduciary relationship between QuickQuote and any User in respect of any funds.
Any dispute concerning a payment made through the Payment Service, including disputes about the amount charged, the standard of services provided, or non delivery of services, is a matter to be resolved directly between the Customer and the Provider, and, where applicable, through Stripe's own dispute and chargeback processes. QuickQuote may, in its sole discretion, make available a record of a transaction to assist Users in resolving a dispute, but has no obligation to mediate, refund, or reverse any payment.
QuickQuote will make available a record of any payment processed through the Payment Service for the Customer's and Provider's own reference. This record does not constitute a tax invoice issued by QuickQuote in respect of the underlying services. Responsibility for issuing any tax invoice for services performed, and for compliance with GST and other tax obligations arising from any amount received, rests solely with the Provider.
QuickQuote does not process, guarantee, or control refunds of any amount paid by a Customer to a Provider through the Payment Service. Any refund is a matter for direct agreement between the Customer and the Provider, given effect, where agreed, through Stripe's own refund functionality. QuickQuote is not liable for a Provider's failure or refusal to agree to or process a refund.
You agree not to use the Platform for any purpose that is unlawful, harmful, or contrary to these Terms. Without limitation, you must not:
We reserve the right to investigate suspected violations of these Terms and to take all appropriate action, including immediate suspension or termination of Accounts, removal of Content, and referral to law enforcement or financial crime authorities where applicable.
QuickQuote has zero tolerance for objectionable content or abusive behaviour. Users may report any Content or other User that is offensive, abusive, harassing, illegal, or otherwise in breach of these Terms by emailing hello@quick-quote.com.au or using the in app reporting function where available. We will review all reports within 24 hours and take appropriate action, which may include removing Content, suspending Accounts, or permanently banning Users. Users may also block other Users directly through the Platform to prevent further interaction.
You retain ownership of all Content you submit to the Platform. By submitting Content, you grant QuickQuote Group Pty Ltd a non exclusive, royalty free, sublicensable, worldwide licence to use, store, copy, reproduce, adapt, transmit, and display that Content to the extent reasonably necessary to operate, provide, and improve the Platform and its Services.
You represent and warrant that you own or have the necessary rights and permissions to submit all Content you post to the Platform; your Content does not infringe any third party intellectual property rights, privacy rights, moral rights, or any other rights; and your Content is accurate, lawful, and not misleading. You are solely responsible for any Content you submit to the Platform.
All intellectual property in the Platform, including but not limited to software, source code, algorithms, design, layouts, logos, trademarks, service marks, and QuickQuote branding (collectively, 'QuickQuote IP'), is owned by or licensed to QuickQuote Group Pty Ltd. Nothing in these Terms grants you any right, title, interest, or licence in or to any QuickQuote IP beyond the limited right to use the Platform in accordance with these Terms.
You must not reproduce, copy, adapt, modify, distribute, publicly display, frame, deep link, or create derivative works from any QuickQuote IP without our express prior written consent.
We reserve the right, but are not obligated, to review, moderate, edit, or remove any Content from the Platform at our absolute discretion, including Content that we reasonably believe violates these Terms, infringes third party rights, or is otherwise objectionable.
The Platform, including the Payment Service, is provided strictly on an 'as is' and 'as available' basis, without any representations or warranties of any kind, express or implied.
To the maximum extent permitted by applicable law, including the ACL, QuickQuote expressly disclaims all warranties, including any implied warranty of merchantability, fitness for a particular purpose, or non infringement; any warranty that the Platform will be uninterrupted, error free, secure, virus free, or free from other harmful components at all times; any warranty as to the accuracy, completeness, reliability, currency, or suitability of any Content on the Platform; any warranty as to the quality, safety, suitability, legality, licencing, insurance status, or reliability of any services offered or provided by Service Providers; and any warranty that the Payment Service will be available, uninterrupted, or free from error at any given time.
This disclaimer does not limit or exclude any rights you may have under the ACL as a consumer that cannot lawfully be excluded by agreement.
To the maximum extent permitted by law, QuickQuote Group Pty Ltd, its officers, directors, employees, agents, and contractors expressly exclude all liability for any loss, damage, injury, cost, or expense arising from or in connection with:
To the maximum extent permitted by law, QuickQuote excludes all liability for any indirect, consequential, special, punitive, or incidental loss or damage, howsoever arising, including loss of actual or anticipated profits or revenue, loss of data, loss of goodwill, loss of opportunity, or business interruption, even if QuickQuote has been advised of the possibility of such loss.
Where our liability cannot be entirely excluded at law, the total aggregate liability of QuickQuote Group Pty Ltd to any User in connection with any claim arising under or in connection with these Terms or the Platform (howsoever arising, whether in contract, tort, statute, or otherwise) is limited to the greater of $100.00 AUD, the total Subscription fees paid by that User to QuickQuote in the twelve month period immediately preceding the event giving rise to the claim, or, where the claim arises from the Payment Service, the platform facilitation fee described in Section 7.3 actually received by QuickQuote in respect of the specific payment giving rise to the claim.
Nothing in these Terms purports to exclude, restrict, or modify any consumer guarantee, right, or remedy available to a consumer under the ACL or any other applicable law that cannot lawfully be excluded or limited by agreement. Where the ACL applies and QuickQuote is found to have breached a consumer guarantee that cannot be excluded, our liability is limited, to the extent permitted by section 64A of the ACL, to re supplying the relevant service or paying the cost of having the service re supplied.
You agree to indemnify, defend, and hold harmless QuickQuote Group Pty Ltd and its officers, directors, employees, agents, and contractors from and against all claims, proceedings, liabilities, damages, losses, penalties, costs, and expenses (including reasonable legal fees on a solicitor client basis) arising from or in connection with:
These Terms commence on the date you first access or use the Platform and continue until your Account is terminated.
You may terminate your Account at any time by contacting us at hello@quick-quote.com.au, through your Account settings, or directly within the Mobile App through Profile, Account Settings, Delete Account. Termination does not entitle you to any refund of Subscription fees paid, except as required by the ACL. Obligations accrued prior to termination survive.
We may suspend or terminate your Account or access to the Platform at any time and without prior notice if we reasonably determine that you have:
Where technically feasible and legally permissible, we will use reasonable endeavours to provide notice of suspension or termination. Suspension or termination of your Account does not automatically close a Connect Account, which continues to be governed directly by your agreement with Stripe.
QuickQuote reserves the right to modify, suspend, or permanently discontinue the Platform, or any part of it, including the Payment Service, at any time and with or without notice. To the extent permitted by law, QuickQuote is not liable to you or any third party for any such modification, suspension, or discontinuation.
Upon termination of your Account for any reason: your licence to use the Platform ceases immediately; any accrued payment obligations survive; and provisions of these Terms that by their nature should survive termination, including Sections 1, 2, 7, 9, 10, 11, 12, 14, 15, and 16, continue in full force and effect.
QuickQuote is not a party to any service agreement or arrangement between a Customer and a Provider. QuickQuote has no obligation, legal or otherwise, to mediate, arbitrate, investigate, or resolve any dispute arising between Users in connection with services, payment for services (whether made through the Payment Service or otherwise), work quality, or any other matter.
QuickQuote may, in its sole and absolute discretion and without any obligation to do so, take steps in connection with a platform related dispute, such as suspending an Account where there is clear evidence of fraud or misconduct on the Platform. Any such steps do not constitute an admission of liability or responsibility on the part of QuickQuote.
If you have a dispute with QuickQuote, you agree to first contact us in writing at hello@quick-quote.com.au with full details of the dispute, and allow us 30 days to attempt resolution in good faith before commencing any legal or regulatory proceedings. Participation in this process does not constitute a waiver of either party’s legal rights.
These Terms are governed by, and construed in accordance with, the laws of the State of New South Wales, Australia, without regard to its conflict of laws principles.
Each party irrevocably submits to the non exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia sitting in New South Wales for the resolution of any dispute arising under or in connection with these Terms or the Platform.
The following additional terms apply if you access the Platform through the iOS Mobile App downloaded from the Apple App Store:
Similar provisions apply to the Android Mobile App in respect of Google Inc. and the Google Play Store.
These Terms, together with the QuickQuote Privacy Policy, Platform Disclaimer, and any other terms incorporated by reference or published on the Platform from time to time, constitute the entire agreement between you and QuickQuote Group Pty Ltd with respect to your use of the Platform and supersede all prior representations, agreements, and understandings.
We may amend these Terms at any time by publishing updated Terms on the Platform. Where amendments are material, we will provide reasonable advance notice, for example via email or a prominent notice on the Platform. Your continued use of the Platform after publication of amended Terms constitutes acceptance of those changes. If you do not accept an amendment, you must cease using the Platform.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, unlawful, unenforceable, or void, that provision will be severed from these Terms and the remaining provisions will continue in full force and effect without modification.
A failure or delay by either party in exercising any right, power, or remedy under these Terms does not operate as a waiver of that right, power, or remedy. No single or partial exercise of any right, power, or remedy prevents any further exercise of that right, power, or remedy or the exercise of any other right, power, or remedy.
You may not assign, transfer, sublicence, or deal with any of your rights or obligations under these Terms without our prior written consent. QuickQuote may assign or transfer any of its rights or obligations under these Terms without your consent, including in connection with any business acquisition, merger, restructure, or change of control.
QuickQuote is not liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure is caused by circumstances beyond our reasonable control, including acts of God, pandemic, natural disaster, cyberattack, telecommunications failure, government action, or power outage, or any outage or failure of Stripe or other third party service provider.
Nothing in these Terms creates or implies any partnership, joint venture, agency, employment, trust, or fiduciary relationship between you and QuickQuote Group Pty Ltd, including in relation to any funds transferred through the Payment Service. You have no authority to bind or make representations on behalf of QuickQuote.
Notices to QuickQuote must be sent in writing to hello@quick-quote.com.au. We will send notices to you at the email address registered on your Account. Notices sent by email are deemed delivered on the next business day after transmission, provided no delivery failure notification is received.
