This Platform Disclaimer ('Disclaimer') is issued by QuickQuote Group Pty Ltd (ABN 99 698 266 483) trading as QuickQuote. It applies to all persons who access or use the QuickQuote platform at www.quick-quote.com.au and the QuickQuote mobile application (available through the Apple App Store and Google Play Store) in any capacity, including Customers, Service Providers, and visitors.

This Disclaimer forms part of your legal agreement with QuickQuote and is incorporated by reference into the QuickQuote Terms of Service and Privacy Policy. By using the Platform, you confirm that you have read, understood, and agreed to be bound by this Disclaimer. If you do not accept this Disclaimer, you must immediately cease use of the Platform.

1. QuickQuote is an introduction platform, not a service provider

The most critical fact about QuickQuote is this: QuickQuote is a digital marketplace. We operate a technology platform that connects people seeking trade or professional services ('Customers') with subscribed service providers and tradespeople ('Providers'). That is the beginning and end of our role — save for the optional, strictly facilitative payment feature described in Section 5, which does not change this fundamental position.

QuickQuote is not a tradie. QuickQuote is not a contractor. QuickQuote is not an agency. QuickQuote is not a bank or a holder of funds. QuickQuote does not employ, engage, control, supervise, or take responsibility for any Provider. QuickQuote does not deliver, warrant, guarantee, or have any involvement in the performance of any services arranged through the Platform.

2. No verification of service providers

Critical warning: QuickQuote does not verify Providers.

QuickQuote does not carry out any verification, screening, credentialling, or background checking of any Service Provider, at the time of registration, at any subsequent point, or at all.

This means that QuickQuote does not verify, confirm, or make any representation about whether a Provider holds any trade licence or registration required by law; whether a Provider has any formal qualifications or training; whether a Provider carries any public liability, professional indemnity, or other insurance; whether a Provider has any prior complaints, convictions, or disciplinary history; or whether any documents, certificates, or credentials uploaded by a Provider to the Platform are genuine, current, valid, or relate to the Provider in question.

Even where a Provider has uploaded documents to the Platform, or the Platform displays an automated 'verified' style badge based on a limited automated check against a business or licence register, QuickQuote makes no representation whatsoever about the authenticity, validity, currency, or accuracy of those documents or that check. You must not rely on the existence of uploaded documents or any such badge as verification of anything, including a Provider's fitness to be paid for work through the Payment Service described in Section 5.

Customers are solely, entirely, and non delegably responsible for conducting all necessary due diligence before engaging any Provider, and before choosing to pay any Provider by any means. This responsibility cannot be transferred to or discharged by QuickQuote.

3. Your due diligence obligations as a Customer

Before engaging any Provider for any services, every Customer must independently carry out, and is solely responsible for carrying out, at minimum, the following:

  • Licence verification: confirm directly with the relevant State or Territory licensing authority that the Provider holds a current, valid, and appropriate licence for the work to be performed.
  • Insurance verification: obtain and review evidence of the Provider's current public liability insurance policy, including coverage amounts, expiry date, and scope of cover.
  • Reference and reputation checks: seek references from prior clients and check independent review platforms.
  • Written quotation: obtain a clear, itemised written quote before authorising any work.
  • Written contract: for any substantial work, ensure a written contract exists that clearly sets out scope, price, timeline, variation procedures, and payment terms.
  • Professional advice: for specialist or regulated work such as electrical, plumbing, or structural work, consider whether independent expert advice is warranted.

QuickQuote bears no responsibility for any harm, financial loss, property damage, personal injury, or other consequence arising from a Customer's failure to conduct adequate due diligence, whether or not the Customer went on to pay the Provider through the Payment Service.

4. No involvement in service agreements or pricing

QuickQuote plays no role in and bears no responsibility for:

  • Any agreement formed between a Customer and a Provider, whether verbal or written.
  • The price, scope, duration, or quality of any services agreed to or performed.
  • The accuracy or fairness of any quote issued by any Provider.
  • Any variation to services, price, or scope agreed between a Customer and Provider.
  • Payment disputes, payment defaults, or non payment for services performed, whether payment was made through the Payment Service or by any other means.
  • Any failure by a Provider to attend, commence, complete, or perform services to any standard.

All terms of any service engagement, including pricing, payment, scope, liability between the parties, warranties, and rectification, are exclusively a matter for direct negotiation and agreement between the Customer and Provider.

5. Payments through the Platform: optional facilitation, no custody of funds

QuickQuote never receives, holds, or has access to your money at any point.

QuickQuote makes available an optional feature (the 'Payment Service') allowing a Customer to pay a Provider for already agreed services, using Stripe, Inc. as the payment processor. Using it is entirely optional — Customers and Providers remain free to pay each other by cash, bank transfer, or any other lawful means outside the Platform, and nothing on the Platform requires use of the Payment Service.

When the Payment Service is used, payment passes directly from the Customer to a Stripe account controlled by the Provider ('Connect Account'). QuickQuote is not a bank, does not operate as an escrow agent, and at no point receives, holds, custodies, or has access to those funds. QuickQuote's only financial interest in a payment made through the Payment Service is a facilitation fee, deducted automatically from the amount paid, in exchange for making the payment feature available — not in exchange for any warranty or guarantee about the underlying services.

QuickQuote does not guarantee that a payment will succeed, that funds will reach a Provider within any particular time, or that a Provider's Connect Account will remain active. Payment processing, fraud checks, and any dispute or chargeback arising from a payment are handled by Stripe under Stripe's own terms (available at stripe.com/legal), not by QuickQuote. QuickQuote is not liable for any act, omission, delay, error, or unavailability of Stripe or the Payment Service.

QuickQuote does not verify any information a Provider gives to Stripe to open a Connect Account, does not process or guarantee refunds of any payment made through the Payment Service, and does not issue tax invoices for the underlying services — a Provider remains solely responsible for their own GST and tax obligations on any amount they receive, however it was paid.

6. No liability for service quality, loss, or damage

Limitation and exclusion of liability.

To the maximum extent permitted by the Australian Consumer Law (ACL) and all other applicable laws, QuickQuote Group Pty Ltd expressly excludes all liability for:

  • Any loss, damage, injury (including death or personal injury), financial loss, or consequential loss suffered by any person arising from or in connection with services arranged, performed, or not performed through the Platform.
  • Any act, omission, negligence, misrepresentation, misconduct, unlawful conduct, or fraud of any Provider or Customer.
  • Any dispute, disagreement, or legal claim between a Customer and a Provider, including in relation to a payment made through the Payment Service.
  • Any reliance placed on any information, Content, profile, review, verification badge, or other material published on the Platform by any User.
  • Any failure, interruption, error, or unavailability of the Platform, including the Payment Service.

Nothing in this Disclaimer limits any consumer guarantee under the ACL that cannot lawfully be excluded. Where the ACL applies and cannot be excluded, our liability is limited to the maximum extent permitted by section 64A of the ACL.

7. Third party conduct and content

The Platform may contain Content submitted by Users, including job postings, Provider profiles, and any photographs or descriptions. QuickQuote does not review, endorse, verify, warrant, or take responsibility for any User generated Content.

Any opinions, statements, representations, or information posted by Users are those of the individual User and do not reflect the views or endorsements of QuickQuote. QuickQuote is not responsible for any inaccuracy, incompleteness, or misleading nature of User generated Content.

QuickQuote may remove Content that it becomes aware of and reasonably determines to be unlawful, harmful, or in breach of its Terms of Service, but has no obligation to actively monitor, review, or police User Content. Users may report objectionable Content or abusive behaviour by emailing hello@quick-quote.com.au or by using the in app reporting and blocking features.

8. Platform availability and technical integrity

QuickQuote operates the Platform on a commercially reasonable basis but makes no warranty or guarantee that:

  • The Platform will be available continuously, without interruption, or at any particular time.
  • The Platform will be free from errors, defects, viruses, or other harmful components.
  • Any errors or defects will be corrected within any particular timeframe.
  • The Platform is compatible with all devices, operating systems, or browsers.
  • The Payment Service will be available at any given time, or free from processing error or delay.

We may take the Platform, or any part of it, offline for maintenance, upgrades, or other operational requirements at any time and without prior notice. To the extent permitted by law, QuickQuote is not liable for any loss resulting from Platform unavailability.

9. No professional advice

Nothing on the Platform constitutes legal, financial, professional, or specialist advice of any kind. Any general information available through the Platform, including anything relating to the Payment Service, is provided for informational purposes only and must not be relied upon as a substitute for independent professional advice specific to your circumstances.

If you are unsure about the licencing requirements, insurance obligations, safety standards, tax obligations, or legal requirements applicable to any work or service, or to any payment received in connection with it, you should seek independent professional advice before proceeding.

10. Dispute resolution: QuickQuote is not a party

QuickQuote is not a party to and has no responsibility for any dispute arising between a Customer and a Provider in connection with any services arranged through the Platform. This includes disputes about:

  • Work quality, defects, or incomplete works.
  • Pricing, invoicing, or payment, including a payment made through the Payment Service.
  • Property damage, personal injury, or consequential loss.
  • Unlicensed or uninsured work.
  • Conduct, communication, or professional standards.

Customers and Providers must resolve any disputes directly between themselves, and, where a payment was made through the Payment Service, through Stripe's own dispute and chargeback processes where applicable. QuickQuote will not mediate, arbitrate, or intervene in disputes between Users, except in circumstances where QuickQuote reasonably determines that Platform specific Terms of Service violations have occurred and where intervention is within our sole discretion.

Users are encouraged to seek independent legal advice in connection with any unresolved dispute involving services arranged through the Platform.

11. App Store distribution disclaimers

The QuickQuote mobile application is made available through the Apple App Store (for iOS devices) and the Google Play Store (for Android devices). The following disclaimers apply:

  • Apple Inc. and Google Inc. are not parties to your agreement with QuickQuote and have no responsibility or liability for the mobile app, its functionality, or any services arranged through it.
  • Subscriptions purchased through the Apple App Store are governed by Apple's standard subscription terms. Subscriptions purchased through Google Play are governed by Google's standard subscription terms. Billing, renewal, and refund processes for mobile subscriptions are managed by Apple or Google, not QuickQuote.
  • QuickQuote, not Apple or Google, is solely responsible for the mobile app's content, maintenance, support, and any warranty claims, to the extent permitted by law.

12. Applicable law and consumer guarantees

This Disclaimer is governed by the laws of the State of New South Wales, Australia. Nothing in this Disclaimer is intended to exclude, restrict, or modify any right or remedy available to a consumer under the Australian Consumer Law that cannot lawfully be excluded or limited. Where any provision of this Disclaimer is found to be unenforceable under applicable law, that provision will be read down to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

13. Indemnification

By using the Platform, you agree to indemnify, defend, and hold harmless QuickQuote Group Pty Ltd and its officers, directors, employees, agents, and contractors against all claims, liabilities, damages, losses, costs, and reasonable legal expenses arising from:

  • Services you provide or receive through the Platform.
  • Any Content you submit to the Platform.
  • Your use of the Payment Service, including any information you give to Stripe in connection with a Connect Account.
  • Your breach of these Terms of Service or this Disclaimer.
  • Your misrepresentation of your qualifications, licences, or other information.
  • Your violation of any law or the rights of any third party.

14. Updates to this Disclaimer

QuickQuote may update this Disclaimer from time to time. Any updates will be published on the Platform with a revised effective date. Where updates are material, we will take reasonable steps to notify registered Users. Your continued use of the Platform following any update constitutes acceptance of the revised Disclaimer.
